Missouri P3 Bill Amended to Clarify Bonding Requirements

Missouri HB 206 would authorize state and local governmental entities to use public-private partnerships (P3s) for the development or operation of all non-transportation buildings, facilities and infrastructure and improvements. SFAA and AIA obtained the following amendments to clarify the bonding requirements for the design and construction portion of the project. As introduced, the bill would have required maintenance, performance and payment bonds, and letters of credit in connection with the development or operation of the qualifying project in the forms and amounts that are satisfactory to the responsible public entity. HB 206 passed out of the House Government Efficiency Committee as amended and has been referred to the House Select Committee on General Laws. SB 512, the companion bill, has not moved since it was introduced.
