Bond Waiver Bill Resurfaces in Cuyahoga County, Ohio

SFAA has learned from its local partners in Ohio that an ordinance providing for a waiver of performance and payment bonds for construction contracts under $250,000 will be introduced in Cuyahoga County, Ohio (Cleveland) today as part of a package of bills designed to help small and minority-owned businesses obtain contracts. Further, if the construction contract has federal funding, bonds would be waived for contracts under $150,000, which is the current threshold for requiring performance bonds under the federal Miller Act. To obtain the waiver, the contractor would have to be pre-qualified through the county. The ordinance follows on a disparity study that the county recently performed in which contractors stated they believe the county’s bond requirements are financially difficult to meet.
