Construction Coalition Bill Introduced in the Senate

Senator Portman’s (R-OH) office confirmed today that the agreed upon provisions from the
Construction Coalition’s procurement reform legislation as a floor amendment to the Senate’s
version of the National Defense Authorization Act (NDAA). We will distribute the text of the
amendment when it is available.
Two surety provisions are in the amendment. One would require the assets that individual
sureties pledge on behalf of a contractor to be the same as those that the contractor could post in
lieu of a bond and that such assets be placed in the custody of the federal contracting
officer. The other surety provision would increase the SBA’s maximum bond guarantee to the
sureties in the Preferred Surety program of its Bond Guarantee Program from 70% to 90%.
The bill also contains the prohibition on the use of reverse auctions and the improvements to the
federal design-build process from the Coalition’s legislation also are included in the amendment.
The Senate is preparing for a floor debate on its NDAA bill and amendments are being filed.
