What's New: Public-Private Partnerships (P3s)

Arkansas P3 Legislation Moving in House with Bonding Amendments

Arkansas HB 1111 would authorize the state and its political subdivisions to use public-private partnerships (P3s) for public infrastructure and public facilities projects. When Arkansas was last in session, SFAA and AIA successfully amended the P3 legislation that was pending to require bonding for the construction portion of the P3, but the bill failed to pass. HB 1111 was introduced this year with our bonding provision in it from last session. When HB 1111 as considered this year, it was noted that the Arkansas Little Miller Act requires only a 100% payment bond so that HB 1111 requires maintenance and performance bonds in compliance with the Little Miller Act, which does not require either of those bonds on public works projects. SFAA worked with NASBP and AIA this session and submitted revisions to address this issue. HB 1111 has been reported out of committee in the House with amendments to the bonding requirements and is heading to the House floor for action. Time is running short in the session.
