DC City Council Passes P3 Bill that Requires Bonding

The DC City Council just voted unanimously to enact Bill 20-595 to create authority in the District to enter into P3 agreements. As originally introduced, the bill would have exempted the P3 agreement from the DC procurement code, including the bonding requirements in the Little Miller Act. SFAA worked with the Council and committee staff this summer, and the bill that was amended and adopted today contains the provision that SFAA recommended, namely, that the Little Miller Act is listed among the few provisions from the procurement code that still are applicable to the P3 agreement. The committee staff confirmed to us that the Little Miller Act is listed in the substituted version of the bill enacted today and will send us an enrolled copy of the bill when it becomes available.
