What's New: Public-Private Partnerships (P3s)

DC City Council Agrees that P3s Should be Bonded

At its meeting last week, the District of Columbia City Council agreed that the construction portions of P3s should be bonded as would be required for any other public works project under the DC Little Miller Act.  SFAA has been working with the committee staff to achieve that result since the bill was introduced this year.  We renewed that effort recently when the committee staff indicated that the bill would move.

Last week, when LB 595, the P3 bill, went to first reading, the Committee amended its report on the bill to note that the bonding provisions from the DC procurement code will be among the items from the requirements from that code that will be applicable to any P3s in which the District is engaged.  The DC legislative counsel is preparing the text of the amendment needed in LB 595 and we expect that it will be incorporated into the bill text on December 2, when the bill moves to second reading.
