Congress Enacts Procurement Reform

Before it adjourned, Congress enacted, and the President signed, the annual National Defense Authorization Act (NDAA), which set the defense policy for the next fiscal year, which included legislation from the House Small Business Committee to permit general contractors to count small businesses in all tiers of a project towards meeting the small business participation requirements. Current law allows prime contractors to count only small businesses that are first tier subcontractors. This new provision will not become effective until fiscal year after the Small Business Administration issues the final regulations to implement this change in the law. Congress gave the SBA 18 months from the date of enactment to develop such regulations.
