Your bond principal has filed for bankruptcy. Now what? Join SFAA for a 1.5 hour webinar to explore the options and rights available to the surety to help it mitigate losses. Concepts to be discussed will include: differences between a debtor’s use of cash collateral and the extension of debtor-in-possession financing; negotiating with the debtor’s pre-petition secured lender; first day orders in chapter 11, including surety program orders; the impact of the automatic stay and how to obtain relief from the stay; the definition of an executory contract and the assumption and/or assignment of same by a debtor; preferential transfers; and enhancing the surety’s prospects for salvage.
